Terms of Service

Welcome to Hirvana (“the Service”). These Terms of Use (“Terms”) govern your access to and use of the website, web application, and all related services provided under the name “Hirvana.” By accessing or using Hirvana, you agree to be bound by these Terms. If you do not agree to all of the following, do not use Hirvana.

1. General Information

1.1 Service Description

Hirvana is an AI powered candidate screening platform. Features include AI powered resume scoring, and AI powered interviews.

1.2 No Incorporated Entity

Hirvana is not operated under an incorporated entity. Any reference to “we,” “us,” or “our” in these Terms refers solely to the owner or operator(s) of Hirvana.

1.3 Jurisdiction

These Terms and any disputes arising from them or relating to them shall be governed by the laws of the State of Arkansas, United States, without regard to conflict of law principles.

2. Eligibility and Accounts

2.1 User Eligibility

Hirvana is intended for use by businesses (B2B). By registering an account, you represent that you are a business entity or an authorized representative of a business entity. There is no minimum age requirement; however, you agree to comply with any relevant local or international age restrictions.

2.2 Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.3 Account Responsibility

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to promptly notify us of any unauthorized use or suspected unauthorized use of your account.

3. Subscription and Payments

3.1 Paid Services

Hirvana may offer paid subscription services. All payments must be made through Stripe, our third-party payment processor. By submitting payment information, you grant us the right to process your payment through Stripe.

3.2 Refund Policy

We do not offer refunds for any fees paid for the use of the Service. By making a payment, you acknowledge and accept that all sales are final.

4. User-Generated Content

4.1 Content Ownership

Users (businesses) may upload candidate resumes, names, email addresses, phone numbers, and other data (“User-Generated Content” or “UGC”). Hirvana does not claim ownership of UGC. By uploading UGC, you grant Hirvana a non-exclusive, worldwide, royalty-free license to host and process the content for the purpose of providing and improving the Service.

4.2 Content Restrictions

You agree not to upload any unlawful, offensive, or abusive content. While we do not actively moderate all content, we reserve the right to remove or restrict access to UGC if we believe it violates these Terms or any applicable law.

5. Privacy and Data Protection

5.1 Data Collection

We collect certain personal information from users, including name, email address, phone number, and resume files. This data is used solely for providing and improving the Service.

5.2 GDPR and CCPA Compliance

To the extent required by law, Hirvana will comply with applicable data protection regulations including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA).

5.3 Data Sharing

We do not share users' personal data with third parties for marketing or analytics purposes. We only share data with third parties (e.g., OpenAI, Stripe) as necessary to fulfill the core functionalities of the Service or to comply with legal obligations.

5.4 Security

We implement reasonable measures to protect user data from unauthorized access or disclosure. However, no data transmission or storage system can be guaranteed to be 100% secure.

6. Intellectual Property

6.1 Ownership

All trademarks, logos, and other intellectual property rights in and to the Service are the property of Hirvana or its licensors. You agree not to use any of these without our prior written consent.
